3.1. Responsibility for Content: Shortsy is a user-generated content platform. You are solely responsible for any Content you create, post, or share. Shortsy does not control, verify, or endorse user-generated Content.

3.2. Platform Role: Shortsy acts as a hosting platform and is not liable for offensive, inappropriate, or unlawful Content posted by users.

3.3. Indemnification: You agree to indemnify and hold Shortsy and its affiliates harmless from any claims, damages, or liabilities arising from your Content.

3.4. Content Removal: Shortsy reserves the right, but not the obligation, to remove or restrict Content that violates these ToS or our Community Guidelines.

4. Privacy Policy

6. Disclaimer of Warranties and Limitation of Liability

6.1. Shortsy is provided “as is” and “as available.” We do not guarantee that the Platform will be error-free, secure, or uninterrupted.

6.2. To the fullest extent permitted by law, Shortsy disclaims all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

6.3. Shortsy is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

7. Governing Law and Dispute Resolution

7.1. These ToS are governed by the laws of the State of Arkansas, United States.

7.2. Any disputes arising under these terms will be resolved through arbitration in Arkansas, unless prohibited by law.

7.3. Counter Litigation Clause: Any attempt to file litigation against Shortsy.net, its owner(s), or affiliates will result in counter-litigation for damages, including but not limited to legal fees and harm to reputation.

7.4. Arbitration Terms:

• Users agree to bear all costs and fees associated with arbitration, including administrative fees and arbitrator compensation, unless otherwise required by law.
• If the user or former user loses arbitration, they will be responsible for all arbitration-related fees and must compensate Shortsy for any damages incurred.

8. Changes to the ToS

8.1. Shortsy reserves the right to update or modify these ToS at any time. Changes will be effective upon posting to the Platform. Continued use of Shortsy constitutes acceptance of the updated terms.
